Affiliate Program
The Affiliate Program, Generally. This section governs your eligibility to participate in the affiliate program (“Affiliate Program”) offered by Picmonic. You are eligible to participate in the Affiliate Program only if you have registered a Picmonic account and if your participation in the Affiliate Program complies with this Agreement. You may send affiliate email invitations only to individuals who consent to receiving messages of this nature from you. You must comply with any applicable laws, rules, and regulations, in addition to this Agreement. You may not post Affiliate discount links on any deals sites or paid ad system.
Who Can Be an Affiliate. No purchase is necessary to create a Picmonic Affiliate account and refer First-Time Purchasers to Picmonic.
Referring a User
How to Refer a User. To participate in the Picmonic Affiliate Program, sign in to your Picmonic account and follow the directions on the Affiliate portal (www.picmonic.com/affiliate-portal) to invite others to purchase Picmonic for the first time (“First-Time Purchasers”). Only First-Time Purchasers that clicked a unique trackable link generated from the My Affiliate page will qualify for a Reward (refunded purchases excluded).
What You Get – Rewards. The Company will log when a First-Time Purchaser accepts your valid invitation and purchases a Picmonic Service (a “Qualifying Purchase”). For every Qualifying Purchases made by a First-Time Purchaser, Affiliate will receive either a $5 Amazon e-gift card or a previously agreed upon share of net-revenue (“Reward”). There is no maximum number of Rewards that you are eligible to receive. In the avoidance of doubt, a Qualifying Purchase means any purchase made by a First-Time Purchaser via Picmonic that is greater than $0 in value. A new user creating a free account or activating a free promotional subscription to a Picmonic Service does not constitute a Qualifying Purchase.
What They Get – Discount. Upon clicking an affiliate link to accept the affiliate invitation, First-Time Purchasers may receive a discount towards a Picmonic subscription (“Affiliate Discounts”). Affiliate Discounts are not applicable toward specials. When You Receive Your Reward. Within 6 weeks of the end of each fiscal quarter, either the Amazon e-gift cards will be made available for redemption via the Affiliate Portal at Picmonic.com/affiliates, or a check for the agreed upon share of net-revenue will be mailed to Affiliate’s address on file. All Amazon e-gift cards must be redeemed and checks cashed within 180 days, or they will be invalidated.
Additional Terms Governing the Affiliate Program
Violations of this Agreement. Any failure to comply with this Agreement or any applicable law may result in suspension or termination of your participation in the Affiliate Program or of your Picmonic account, all in the sole and absolute discretion of Picmonic. Affiliate invitations may expire in accordance with this Agreement. Participation in the Affiliate Program may be limited to individuals or organizations located in certain countries or using certain currencies, and is void where prohibited by law. Picmonic reserves the right to modify or terminate the Affiliate Program at any time and for any reason. You are expressly prohibited from taking any action intended to circumvent the terms of this Agreement. Picmonic reserves the right to cancel or rescind Rewards if it determines in its sole and absolute discretion that any party has violated this Agreement for any reason, including, but not limited to, fraudulent, harassing, or misleading affiliate activity (for example, by using multiple identities, email addresses or Picmonic accounts, otherwise providing false or misleading information, spamming, or conducting any kind of general shenanigans, funny business, or skullduggery with the intent to circumvent this Agreement) or if your Picmonic account is closed for any reason. If someone has asked you to stop sending them messages about Picmonic, respect their request.
Your Relationship With Picmonic. Your participation in the Affiliate Program is voluntary and that of an independent contractor. This Agreement does not, and shall not be construed to, create an employer-employee, agency, joint venture, or partnership relationship between you and Picmonic. You may only send valid affiliate invitations in accordance with this Agreement. You shall not, without Picmonic’s written permission, include any Picmonic trademarks or other Picmonic materials in your communications related to the Affiliate Program. Do not misrepresent or embellish your relationship with Picmonic or write, say, or post anything you know is untrue or misleading. Do not make performance, price, or other claims about Picmonic Services.
